Professional Liability Insurance

If my employer has professional liability insurance, what should I know about it?

Here are questions to ask about coverage:

  • Are you referred to by name in the employer’s policy?
  • Is your employer willing to provide you with written verification, such as a Certificate of Insurance, to confirm that you are covered?
  • Does your employer’s policy have a separate limit of liability for you, so your coverage is not used up by claims made against others covered by the employer’s policy?
  • Does your employer’s coverage provide for legal costs for you, even when your interests may be in conflict with the employer’s?
    • SDMS Liability Insurance provides coverage to pay for legal expenses incurred in defending yourself against a claim made against you. This is in addition to your other policy coverage limits.
  • Will your employer’s policy cover you if you work on a contract basis outside regular work hours?

Here are questions to ask about case resolution and payment:

  • Will your employer advise you of a settlement offer from a litigant before the settlement is accepted? (This is called consent to settle.)
  • Will your employer reimburse you for lost income due to court appearances or meetings?
    • SDMS Liability Insurance will reimburse you up to $2,500 for counsel fees and expenses if you are required to provide a deposition related to covered services performed, even if you are not a direct defendant in the action.
  • Will your employer reimburse your costs of legal representation for licensure and/or administrative review?
    • SDMS Liability Insurance will reimburse you for up to $5,000 per incident per year for expenses defending yourself in a state regulatory authority investigation.

In addition, SDMS Liability Insurance:

  • Broadens your coverage automatically if the insurance company broadens the coverage form
  • Covers bodily injury, property damage, or personal injury claims, not to exceed the limit of liability stated in policy declarations and subject to all policy terms
